PUBLIC NOTICE
Proposed to amend 10 Guam Code Annotated Health and Safety, Chapter 76.

The Guam Environmental Protection Agency (Guam EPA) is proposing to amend 10 Guam Code Annotated Health and Safety, Chapter 76, Underground Storage of Regulated Substances Act (Act).

The propose Act will enable Guam EPA to establish regulations, standards, policies and enforcement for underground storage of regulated substances that ensures consistent maintenance, installation, inspection, and testing by licensed and certified professionals and cleanup and mitigation of the damage they cause.

Copies of the amended Act is available for pickup between the hours of 9 a.m. and 4 p.m., Monday through Friday (except holidays), at the Guam EPA's Main Office in Tiyan. The office is located at Building 17-3304, Mariner Avenue across from the former Department of Revenue and Taxation. The document can also be downloaded here or viewed at www.guamepa.net.

The public comment period begins on May 27, 2008, and closes July 10, 2008. Interested persons wishing to submit written comments on the Act must do so by July 10, 2008, either by hand delivery to the Guam EPA's Main Office or by mailing to:

Proposed Issuance of Underground Injection Control Well/System Operating Permit for P.H.R. Micronesia, Inc.

The Guam Environmental Protection Agency has received U.S. EPA approval to implement the Underground Injection Control (UIC) Program, as mandated by the Safe Drinking Water Act.

The Agency is regulating all applicable activities as set forth in the Guam's Underground Injection Control Regulations. The UIC program requires the issuance of operating permits for all existing injection systems which were constructed prior to the approval of the regulations and are still in operation in addition to those wells/systems constructed after the effective date of the regulations.

The Agency has received an application from P.H.R. Micronesia, Inc. for UIC operating permits of fifty (50) existing drainage systems located at Hyatt Regency Guam, Pale San Vitores Road, Tamuning, Guam. Hyatt Regency is a hotel/resort with retail stores and subsurface drainage systems located along driveways, landscaping, parking, and swimming pool areas.

On the basis of a preliminary UIC requirement review, the Administrator proposes to issue UIC permits to allow discharges of stormwater runoff into the injection systems.

The discharges for the proposed injection systems consist of stormwater runoff only. No industrial discharges or any discharges are allowed into the injection systems.

The permits for the above application will require:
(1) only stormwater runoff to be discharged into the injection systems
(2) semi-annual monitoring of water quality for MBAS, Oil and Grease, NO3-N, Endrin, Lindane, Toxaphene, 2, 4-D, 2, 4, 5-TP Silvex, Heptachlor, Methoxychlor, Lead, Benzene, Ethylbenzene, Xylene, Toluene, MTBE, Boron, COD, and pH;
(3) assurance regarding repairs, replacement, or abandonment of the wells/systems in the event of failure;
(4) a laboratory analysis report of runoff water actually taken from the designated sampling point of the system; and
(5) compliance with other UIC requirements.

The Agency has received applications from E. C. Development Ltd. for UIC operating permits of two (2) existing drainage systems located at Palm Village, Harmon Loop Road, Dededo, Guam. Palm Village is a commercial building for restaurants, health and dental clinics, laundromat, amusement machines, and offices. The building has subsurface drainage systems at the parking areas.

On the basis of a preliminary UIC requirement review, the Administrator proposes to issue UIC permits to allow discharges of stormwater runoff into the injection systems.

The discharges for the existing injection systems consist of stormwater runoff only. No industrial discharges or any discharges are allowed into the injection systems.

The permits for the above application will require:
(1) only stormwater runoff to be discharged into the injection systems;

The Guam Environmental Protection Agency has received U.S. EPA approval to implement the Underground Injection Control (UIC) Program, as mandated by the Safe Drinking Water Act.

The Agency is regulating all applicable activities as set forth in the Guam's Underground Injection Control Regulations. The UIC program requires the issuance of operating permits for all existing injection wells/systems which were constructed prior to the approval of the regulations and are still in operation in addition to those wells/systems constructed after the effective date of the regulations.

The Agency has received an application from Comete Guam, Inc. for UIC operating permit of one (1) subsurface system located at the parking area of Comete Building, Pale San Vitores Road, Tumon, Guam. Comete building is a four-storey commercial building comprise of Underwater World Aquarium, Sam Choy Restaurant and various retail stores.

On the basis of a preliminary UIC requirement review, the Administrator proposes to issue UIC permit to allow discharges of stormwater runoff into the injection system.

The discharges for the proposed injection system consist of stormwater runoff only. No industrial discharges or any discharges are allowed into the system.

The permit for the above application will require:
(1) only stormwater runoff to be discharged into the injection system;
(2) semi-annual monitoring of water quality for MBAS, Oil and Grease, NO3-N, Endrin, Lindane, Toxaphene, 2, 4-D, 2, 4, 5-TP Silvex, Heptachlor, Methoxychlor, Lead, Benzene, Ethylbenzene, Xylene, Toluene, MTBE, Boron, COD, and pH;

(6) compliance with other UIC requirements.

PUBLIC NOTICE
Notice of Intent to Issue a Hazardous Waste Management Facility Permit for Andersen Air Force Base, Yigo

The Guam Environmental Protection Agency (Guam EPA) wishes to notify the general public and other interested parties of the availability of the draft Resource, Conservation, and Recovery Act (RCRA) Permit for Andersen Air Force Base, Guam Hazardous Waste Management Facility.

Once the RCRA Permit is effective, it would grant Andersen Air Force Base (permitee) approval to operate a hazardous waste management facility in accordance with 10 Guam Code Annotated (GCA), Chapter 51, Solid Waste Management and Litter Control Act, Guam's Hazardous Waste Management Regulations Part XI, and RCRA, Title 40 of the Code of the Federal Regulations (CFR) Part 124, as authorized by the 1984 Hazardous and Solid Waste Amendments (HSWA). The draft RCRA Permit and its conditions are proposed and open to the public comment pursuant to Part XI [Adopts by reference 40 CFR 124] in Guam s Hazardous Waste Management Regulations. The Permit will also allow Guam EPA to more effectively oversee the cleanup of solid waste management units (SWMUs) not addressed under the Superfund cleanup for Andersen Air Force Base.

The Permit is being issued to Andersen Air Force Base, Guam to operate a hazardous waste treatment facility located in Yigo, Guam. The facility, also known as the Explosive Ordnance Disposal (EOD) Range is located within the boundaries of the Air Force Base at the extreme reach of Tarague Beach ending just before Tagua Point. Andersen Air Force Base is a federal installation in Guam that is currently the home of the Pacific Air Force's 36th Wing.

The Administrative Record for the draft RCRA Permit, which includes the draft RCRA Permit and Fact Sheet are available for public review between the hours of 8 a.m. and 5 p.m., Monday through Friday, at the Guam EPA's Main Office, 15-6101 Mariner Avenue, Tiyan. The Public comment period begins on March 17, 2008, and closes April 30, 2008. The fact sheet can be downloaded here. Copies of the Fact Sheet may be obtained at the Guam EPA's Main Office.

Guam EPA will have a Public Hearing regarding this permit if the Guam EPA Administrator finds, on the basis of requests, there is a significant amount of public interest. Requests for a Public Hearing must contain the requestor's name, contact number and reason for requesting a hearing. If a Public Hearing is granted, a public notice stating the date, time and place of the hearing will be made at least 30 days prior to the hearing and the comment period will be extended through the hearing date.

The Guam Environmental Protection Agency (Guam EPA) is requesting public review and comment on the draft Permit to allow the processing of old corrugated cardboards and aluminum cans for the Guahan Waste Control, Inc. One permit would allow the processing of metallic waste and the other permit would allow the storage of metallic waste, used batteries and waste tires for the FSM Recycling Inc. (permitee). The Guam Environmental Protection Agency (Guam EPA) is requesting public review and comment regarding a draft permit for Waste Management Services (permitee). The permit would allow the permitee to process approximately 450 pounds of medical waste daily by steam sterilizing and maceration. The maximum monthly thru-put of medical waste to be handled at the processing facility is expected to be no more than 9,000 pounds a month. The facility is located at Lot Number 2140-9 in Tamuning, Guam.

The permits and permit conditions are available for review during this public comment period pursuant to Article 1, §51104(d), 10 GCA Chapter 51, Solid Waste Management and Litter Control Act, and Article 1, §23104(d)(4) of the Guam EPA Solid Waste Disposal Rules and Regulations. Under this law, the permitee is required to obtain a processing permit and abide by its conditions. Conditions for the processing of medical waste are described in detail within the draft Processing Permit.

Notice of Intent to Issue a Major Source Operating Permit for the Agaña Shopping Center

The Guam Environmental Protection Agency (Guam EPA) is requesting public review and comment on a draft Permit to allow construction and operation of a proposed power generation system at the Agaña Shopping Center (permitee) located in Hagatña, Guam. The facility is located at 302 S. Route #4 in Hagatna, Guam.

The permitee is required to obtain a Permit to Operate in accordance with the Guam Air Pollution Control Standards and Regulations and the Clean Air Act. The proposed permit contains stipulations that require the permitee to conduct monitoring. This monitoring shall be sufficient to enable Guam EPA and the public to determine whether the permitee is complying with the applicable air quality requirements. Proposed Issuance of Underground Injection Control Well/System Operating Permit for U.S. Naval Base Guam

The Guam Environmental Protection Agency has received U.S. EPA approval to implement the Underground Injection Control (UIC) Program, as mandated by the Safe Drinking Water Act.

The Agency is regulating all applicable activities as set forth in the Guam's Underground Injection Control Regulations. The UIC program requires the issuance of operating permits for all existing injection wells/systems which were constructed prior to the approval of the regulations and are still in operation in addition to those wells/systems constructed after the effective date of the regulations.

The Agency has received an application from U.S. Naval Base Guam, for UIC operating permits of two (2) injection systems which are located at Guam High School, Johnson Road, U.S. Naval Hospital Compound, Agana Heights, Guam. The injection systems are located along the parking area and in front of the football soccer field.

On the basis of a preliminary UIC requirement review, the Administrator proposes to issue UIC permits to allow discharges of stormwater runoff into the injection systems.

The discharges for the proposed injection systems consist of stormwater runoff only. No industrial discharges or any discharges are allowed into the injection systems.

The permits for the above application will require:
(1) only stormwater runoff to be discharged into the injection systems
(2) semi-annual monitoring of water quality for MBAS, Oil and Grease, NO3-N, Endrin, Lindane, Toxaphene, 2, 4-D, 2, 4, 5-TP Silvex, Heptachlor, Methoxychlor, Lead, Benzene, Ethylbenzene, Xylene, Toluene, MTBE, Boron, COD, and pH;
(3) assurance regarding repairs, replacement, or abandonment of the wells/systems in the event of failure;
(4) a laboratory analysis report of runoff water actually taken from the designated sampling points of the system; and
(5) compliance with other UIC requirements.

Tomson LLC/Pacific Waste Systems, Mangilao - Solid Waste Management Processing and Storage Facility Permits

The Guam Environmental Protection Agency (Guam EPA) wishes to notify the general public and other interested parties of the availability of the Solid Waste Management Processing and Storage Facility Permits (hereinafter referred to as "Draft Processing Permit" and "Draft Storage Permit") for Tomson LLC/ Pacific Waste Systems (hereinafter referred to as "Permittee"). The Solid Waste Management Processing and Storage facility is located on Lot Number 7030 New-2-1 Mangilao.

The draft Processing Permit proposes the shredding of waste tires and the processing of computer processing units. The maximum monthly thru-put of waste tires to be handled at the processing facility is expected to be 96 tons a month. The maximum monthly thru-put of computer processing units to be handled at the facility is expected to be no more than 5 tons a month. Conditions for the processing of waste tires and computer processing units are described in the draft Processing Permit.

A Storage Permit is also being issued for the storage of waste tires and computer processing units. The maximum quantity of waste tires to be stored at the storage facility is expected to be no more than 96 tons at any given time. The maximum quantity of computer processing units to be stored at the facility is 5 tons at any given time. Conditions for the storage of waste tires and computer processing units are described in the draft Storage Permit.

Once the draft Processing and Storage Permits are effective, the Permittee will operate the facility in accordance with the 10 Guam Code Annotated (GCA) Chapter 51, Solid Waste Management and Litter Control Act. The Processing and Storage Permits contain conditions for the operations within the facility, including the types and amount of solid wastes to be processed and stored.
